Under the EB1 Green Card Program there are 40,000 green cards allocated between the following groups:

China,

India,

Mexico,

Philippines

and All Countries

If anyone of these groups exhaust their quota for the year, further EB1 applications will be placed in a queuing system, that is called retrogression.

On May 10th 2017 EB1 Green Cards for China and India go into Temporary Retrogression until October 1st 2017

As of May 11th 2017, the quotas for China and India went into temporary retrogression. What this means is that until the October 1st 2017, new allotment of green cards are released; no further green cards can be issued to citizens of China and Indian applying under the EB1 Green Card Program.

In the meantime, we shall still be filing our cases as normal, in terms of getting the Form I-140 EB1 Petition approved for the designation of Alien of Extraordinary Ability and moreover we should still file our I-485 Application for Permanent Residence. In the latter, the green card will be processed as normal but not issued until the quota has been re-set as outlined above. If you scroll down to Section D of the U.S. Visa Bulletin – you see for yourself that that USCIS expects these visas to be ‘current’ for the fiscal year Starting October 1 2017 – September 2018.

The message to all Chinese and Indian EB1 Candidates – if you think you might qualify for an EB1 green card do not delay. As the popularity of the EB1 green card continues to grow there is a real danger of the EB1 program permanently falling into retrogression. Typically, come October 1st of each year the retrogression is cleared, but this might now always be the case in the future, so do not delay.
