EB1 Check List:

(vii) Evidence of the display of the alien’s work in the field at artistic exhibitions or showcases;

Having your work displayed in public can take many forms such as an Art Exhibition in a museum, having your designs displayed in the form of a fashion show, maybe a live musical performance or a stage play.  These displays in exhibitions or showcases must meet some additional criteria in order to meet this EB1 green card category.

The event or location of the exhibition or showcase must be distinguished, for example, if we’re talking about a stage play then the location of the play would need to be at some prestigious theatre with a great history where many leading and well known actors have graced the stage. You also need to be thinking about whether your play where you might have played a leading, co-starring or ensemble role garnered any press at all and whether your name was in any way mentioned. Maybe the brochure or program of the play shows your role prominently as a leading participant. It would be a collection of these elements that would be key indicators to the EB1 green card examiner as to whether the exhibition or showcase was of a significant level in line with the overall claim of the alien being one with an extraordinary ability.

A fashion designer whose work is showcased on a catwalk is also required to demonstrate that the event was a distinguished affair. Maybe many celebrities were in attendance as well as other leaders within the fashion world. Remember, the EB1 green card examiner was not there so we need to bring the showcase to the examiner as it were.

EB1 green card examiners need to be persuaded as to the level of the event because they have seen the cases where the claim of the exhibition or showcase being prestigious turned out to be no more than a very low key uneventful affair perhaps little more than a parochial town event. So the only way the EB1 green card examiner will be able to tell the difference is if we’re able to skillfully compile a plethora of evidence to show the examiner the true extent and prestige of the event.

Exhibitions also have to be well documented. We have to first determine how the art came to be exhibited, how was it selected, was it a one man show or multi-artist show. Was the event a small local art gallery just having a wine and cheese event or are we talking about a distinguished Museum or renowned art gallery. Was the event well publicized in the art press? As your EB1 US Immigration attorney my job will be to interview you on everything surrounding every aspect of your connection to this category and determine how best to gather and present your evidence; polishing it up, if you will so that the EB1 green card examiner is completely clear as to the level of prestige we’re talking about and is duly satisfied as to the requirements of this category being met.

It is perhaps worth noting that the Exhibition or showcase must be of your work. So for example using the fashion show idea, if you did the make up for a leading model or the lighting for the show or you provided the sound, lighting or security, then these roles are all considered secondary and not suitable within this category; such activities maybe critical responsibilities that are also recognized within the EB1 green card categories, but not this particular category.  For this EB1 category the primary purpose of the event must be to view the alien’s work. So in a fashion it would be the designer’s clothes, for a stage play it would be the actors on stage and for an art exhibition it would be the actual art or artistic performance that would satisfy this EB1 green card category.

The EB1 green card 8 C.F.R. 204.5(h) (3) – category (vii) is perhaps the most understated category and should not be underestimated, however, if you have had your work exhibited or showcased at a distinguished venue, with a lot of fanfare and possibly press then this category is well worth including on your list of possible EB1 green card categories we may be able to prepare for you.
